What is Proper Courtroom Etiquette?
- If the person sitting on the bench wears a red sash, he or she is a Judge.
- If the person sitting on the bench wears a green sash, he or she is a Justice of the Peace or what is also commonly referred to as ‘JPs’.
- We address Judges as ‘Your Honour’ and we address Justice of the Peaces as ‘Your Worship’.
- The courtroom is a public setting. Anyone can be there. However, not everyone can go beyond the ‘bench’ or the first row of benches.
If you do not have a lawyer, you will wait until your name is called and this might take a while as the court will speak to the matters first where lawyers are there on behalf of the clients as well as individuals who are currently held in custody.
Depending on the number of people on the list (sometimes it is hundreds). You could be waiting a few hours before your matter is called.
Your matter could be called at any time after your scheduled time. Be prepared to be there until your matter is called.
To the right side of the courtroom, is the Crown Prosecutor.
The Crown is there for everyone’s matter in that courtroom. The Crown is representing the Prosecution side and will not necessarily be the assigned Crown to your case.
